STANDARD TERMS AND CONDITIONS

 

1. Application
1.1 These terms and conditions apply to all services provided by New Stamford School (referred to as NS).
1.2 In the event of any conflict between these terms and conditions and any other terms and conditions, these terms and conditions shall prevail unless NS expressly agrees otherwise in writing.


2. Contract
The contract between NS and the student will exist only when an enrollment is accepted by NS and the student has paid an initial deposit equivalent to the first 3 months’ program fees in full.

3. Payment Terms
3.1 To enroll in our school and initiate the visa paperwork process, a deposit equivalent to the first 3 months’ program fees is required. This deposit must be paid within 7 days of submitting your application.3.1.1 For those obtaining an education visa abroad at a Thai embassy or consulate, the remaining balance of the program fees will be due upon arrival in Thailand and must be paid within 7 days of the start of the program.
3.1.2 For those converting their visa without leaving Thailand, the remaining balance of the program fees must be paid within 7 days of receiving approval from the Ministry of Education.
3.2 All payments must be made in Thai Baht by cash, bank transfer, or card. The student is responsible for any applicable bank charges relating to the bank transfer.
3.3 If the student fails to pay the remaining balance of the program fees by the due date, NS reserves the right to immediately cancel the contract and retain the deposit.
3.4 Upon entering Thailand with the education visa obtained through our school, the student must report to our school within 7 days to ensure compliance with visa regulations and to allow us to keep track of our students.
3.5 Failure to fulfill the visa appointment schedule or not appearing for the appointment may result in the inability to complete the visa conversion process, and the student will not be entitled to any refund.
3.6 The student must allow sufficient time for the visa conversion process to be completed without any delays or complications.

4. Refund/Cancellation
4.1 The deposit equivalent to the first 3 months’ program fees is non-refundable once the documentation has been submitted to the Ministry of Education.
4.2 If the student cancels their enrollment after the documentation has been submitted to the Ministry of Education, the initial deposit equivalent to the first 3 months’ program fees will not be refundable.
4.3 In the event of rejection of the student by the Ministry of Education, NS will refund the deposit minus a 1,500 Baht administration fee.
4.4 Once NS has received the approval documents from the Ministry of Education, the deposit equivalent to the first 3 months’ program fees will no longer be refundable.
4.5 If NS cannot contact the student through standard communication avenues (such as email, telephone, or messenger) within 45 days of receipt of documentation from the Ministry of Education, NS School will retain the deposit equivalent to the first 3 months’ program fees, and the application process will be voided.
4.6 Once the student has received the approval documentation from the Ministry of Education, they will have approximately 60 days of validity based on the date issued on the document. Students must apply to the immigration office or embassy/consulate within this time; otherwise, NS will offer to re-submit documents for an additional fee of 2,000 Baht (plus any costs of postage).
4.7 Students must maintain communication with NS and inform us of any issues (which may be passed on as supporting documents).
4.8 If students cannot be reached via agreed-upon communication channels (without prior warning or agreement) for over 45 days, NS will void the application, and no refund will be available. It is the responsibility of the student to ensure that NS has accurate and up-to-date contact information, and to inform NS of any changes to their contact details.
4.9 If the immigration office or embassy/consulate declines the student’s application, NS will offer a refund of the full program fee minus a 6,500 Baht administration fee. Students must inform NS and provide official proof of rejection before the end of the validity period stated on the approval letter from the Ministry of Education.
4.10 Once the visa has been granted by the immigration office or embassy/consulate, no refund will be available. In the event that the student chooses to resign from the course, change visa, or otherwise, no refund will be available.
4.11 If students fail to adhere to immigration rules (such as not acquiring relevant re-entry permits to leave and return to the country or failing to attend their 90-day extension), resulting in their visa being voided, no refund will be available.

5. Withdrawal or Resignation
No refund will be available in the event that the student chooses to withdraw or resign from the course. NS defines withdrawal as termination of a course after the course has started. Any withdrawal or resignation must be made in writing to the School Director, in order to arrange all relevant visa issues and cancellations in time before the student’s last day.


6. Refund Procedure
6.1 If students meet the refund criteria stated under clause 4 “Refunds/Cancellation”, the student must provide the following documents to NS in order to process the refund: the signed contract, receipt or evidence of payment, and evidence to support the refund (i.e., in case of visa rejection, receipt of rejection or similar).
6.2 NS will review the refund request and submitted supporting documents and reply within 7 working days with the decision.
6.3 If all steps have been correctly followed, the refund will be issued via the original payment method. Please note that banks can take several days to process such cases, especially regarding international payments. NS will provide proof of sending the refund.
6.4 Any charges (for international bank fees, etc.) incurred will be the sole responsibility of the student.

7. Expulsion
7.1 NS reserves the right to expel any Student whose behavior is, in NS’s sole opinion, considered to be inappropriate and/or unacceptable. In such circumstances, the student shall be entitled to immediately cancel the Contract upon noting in writing to the student and retain the fees paid. In addition, the student will be solely responsible for organizing, supervising, and meeting the cost of the student’s journey home.
7.2 For the avoidance of doubt, inappropriate and/or unacceptable behavior shall include, but is not limited to, underage drinking of alcohol, possession, or use of illegal drugs, smoking in restricted areas, malicious damage to property, threatening or aggressive behavior, law breaking, and breach of curfews.

8. Insurance
NS does not provide students with health, accident, or travel insurance for their stay in Thailand, and it is strongly recommended that the student takes out fully comprehensive insurance cover.

9. Visa
9.1 NS is in no way responsible for any additional fees incurred in order to obtain the visa and other immigration documents, including (but not limited to) traveling costs, accommodation, visa fees charged by the immigration office, embassy, or consulate, or fees incurred due to immigration requirement changes. (Please note that each embassy asks for different documentation; students must check with the chosen embassy and inform NS of the required documents and be aware of any upcoming public holidays in the country of application).
9.2 Students from certain countries (list available upon request) must apply for visas at an embassy in their own country and cannot apply in neighboring countries. It is the student’s responsibility to check this, and NS will not be held responsible for any costs incurred due to this requirement.
9.3 Once the visa has been granted, and the student arrives back in the country, students must report to NS within 7 days. According to Thai immigration rules, foreigners must also report their address to immigration (TM30) within 24 hours of arrival into the country. If students fail to do so, the student will be liable to pay a fine or any additional fines imposed by the immigration department or related authorities. 10. Visa Validity Duration
Each course is only valid for the length of the student’s visa, awarded by immigration, which is based on the first day of arrival (not necessarily the first day of study). NS have no control over the visa length or validity and can only provide tuition whilst the student is under the Education Visa. In the event that the visa is cut short or changed, we will be unable to offer a refund for any remaining tuition time or program fee.

11. 90-Visa Extension and the 90-day Report
11.1 Students must apply for a visa extension every 90 days to continue their stay until the end of their full visa validity.
11.2 NS will request a visa extension letter from the Ministry of Education, which typically takes 30 business days to process. The visa extension letter is valid for 30 days from the date of issue. Therefore, NS will plan the timeline for your visa extension 15 days before the expiration date of your current visa. According to immigration regulations, students can apply for a visa extension 45 days prior to the expiration of their current visa. However, if students wish to do so, they must inform NS in advance to allow sufficient time for the Ministry of Education to process the approval of the visa extension paperwork. Failure to do so may require an expedited process, for which a fee of 1500 baht will be charged to the student.
11.3 If students fail to extend their visa or report their address within these time periods, students may be subject to immigration fines, visa termination, and even deportation. NS will not accept any liability in this event.
11.4 Once a student’s visa has been extended and their 90-day report has been completed, it is required that they send NS a scanned copy of their updated visa extension page and 90-day reporting receipt within 7 days. This is important for NS to keep for immigration purposes and to start the process of acquiring the next visa extension from the Ministry of Education. It is important to note that NS will not be able to apply for the next visa extension without the new updated visa extension page. Failure to send the updated documents to NS within the specified timeframe may result in a delay in arranging for the student’s next visa extension.

12. Passport Validity
According to the regulations, immigration can grant a student visa for as long as your passport remains valid. In the event that your visa is cut short due to your passport’s insufficient length of validity, we will be unable to offer a refund for the program fee. The student is solely responsible for any additional fees incurred as a result of transferring a visa to a new passport.


13. Immigration’s Discretion
Chiang Mai Immigration has the authority to conduct routine checks on international students’ status and may require you to visit their office at any time or request a visit to NS outside of the regular visa process. It is essential to comply with immigration rules and regulations to ensure a smooth and successful study experience. In case of any issues or concerns, our team at NS is available to provide guidance and support to our students. Please note that any failure to comply with immigration regulations may result in the cancellation of your visa, and NS will not be liable for any resulting consequences.


14. Travelling outside of Thailand during your Non-Immigrant, type ED Visa
14.1 If a student wishes to leave Thailand, they must apply for a Re-entry permit at least 7 days in advance of their trip. The Re-entry permit can be obtained at any immigration office, or the student may do so on the day of their departure at any international airport. However, if the permit is obtained at the airport, it must be done on the same day of departure. Suvarnabhumi Airport provides a 24-hour service for re-entry service. It is important to note that if a student leaves the country without applying for a Re-Entry permit, their visa will be cancelled, and they will not be eligible for a refund as stated in the “Refund/Cancellation Clause 4”.
14.2 If a student travels outside of Thailand and is refused entry upon their return under their Education visa, due to the inability to meet immigration requirements at the port of entry, NS reserves the right to terminate their visa. It’s important to note that any fees or charges associated with visa termination or cancellation will be the sole responsibility of the student. If the option to re-enroll the student into the course at NS is available, NS will offer to re-process the documents for an additional fee of 6,500 Baht (plus any costs of postage). This fee covers the administrative costs associated with the visa application and documentation process.

15. Public holidays
Classes are not given on public holidays and no refund or compensation is given for lessons not held on those days.

16. Photography and Filming
NS may take photographs and videos of students from time to time for various purposes. One of the reasons is to provide proof of student attendance to the Ministry of Education and the immigration office, who may occasionally check NS’s social media accounts. Additionally, NS may use these photographs and videos for promotional purposes.

17. Liability
NS will not be held responsible for any failure to comply with its obligations if the failure is caused by circumstances beyond the school’s reasonable control. NS will also not be responsible for any costs incurred by the student or their family resulting from such circumstances. These circumstances may include, but are not limited to, war, the threat of war, civil unrest, industrial disputes, terrorist activities, natural or nuclear disasters, extreme weather conditions, or government orders or advice. If any student causes damage to the school’s property or to any residential accommodation provided by NS, whether intentionally or not, the costs for repairing or replacing the damaged property will be charged to the student or students responsible.

18. Right
NS reserves the right to change prices, cancel or modify courses, and adjust timetables at any time. Additionally, NS may make additions or modifications to these terms and conditions. All affected parties will be notified of any changes by providing one month’s written notice. However, if any changes in regulations by the Ministry of Education or immigration affect the changes and require immediate enforcement, NS may not be entitled to provide one month’s written notice to all affected parties.

19. Jurisdiction
In any dispute arising out of this contract, the parties expressly agree to submit to the jurisdiction of the courts of the Kingdom of Thailand having jurisdiction in the matter in question.

20. Publicity Materials
Permission is given by the student, their parents or guardian with acceptance of these terms and conditions for the use in NS’s promotional materials of student comments, opinions, images, or video, whether produced by NS or by nominated third parties.
